    About Case Evaluation

    Case evaluation is yet another form of ADR, frequently referred to as early neutral evaluation. Unlike other forms of ADR, case evaluation may be utilized soon after a case has been filed in court. Case evaluation, as the name indicates, provides an opportunity for a non-binding, neutral case review. Simply stating, case evaluation is a reality check. The goals is to assess the merits of the case at hand, and to facilitate direct communication between the parties.

    Case Evaluation Process

    Case evaluation is a non-binding procedure in which the parties to a dispute submit written case evaluation statements to a neutral evaluator. The evaluator may be a three person unbiased panel. The submitted written case, provides a summary of applicable legal theories and existing evidence. In addition, each party gets a chance to present their case and hear the other side. The evaluator assesses the strength and weaknesses of each side’s case and helps the parties narrow the legal and factual issues in the case. Most importantly, the neutral evaluator assesses how the dispute is likely to be decided by a jury or other adjudicator.

                    

    Benefits of Case Evaluation

    Case evaluation may be utilized soon after a case has been filed in court. However, like the mediation process, case evaluation can also come early in the dispute, resulting in early case settlement. The case evaluation process is a reality check. Thus, it is most effective in cases where the parties unrealistic expectations are hindering the road to the final solution. As with mediation or arbitration, case evaluation is more flexible, less stressful, quicker, and often less expensive by eliminating administrative court costs, attorney and expert fees.
